1. SCOPE OF APPLICATION
The J. Grubenmann Atelier, based in Appenzell (hereinafter referred to as ‘JG’), is an online retailer of women's fashion and accessories with a focus on design, quality, and sustainability. These terms and conditions apply to all orders placed on the website http://www.jgrubenmann.ch in the version valid at the time of the order.
2. ORDERING AND CONCLUSION OF CONTRACT
You place an online order in our shop. The order becomes binding once you have agreed to the terms and conditions and clicked the BUY button. This creates a legally valid purchase contract. After receiving your order, you will receive an order confirmation from us via email.
3. OUR DELIVERY AND SALES TERMS
After order confirmation, we will send the ordered items to the delivery address you provided via parcel delivery. The delivery time is as indicated for each design in the shop. For orders from abroad, the delivery time may be extended by a few business days. If delivery of the goods fails despite several delivery attempts, JG may withdraw from the contract.
4. OFFER
Our online offer is subject to change and non-binding. The items offered in the online shop are generally available. Should it be impossible to deliver one or more items due to a stock discrepancy, JG will inform you of this as soon as possible and offer you equivalent items. If none of these items are acceptable to you, the amount will be refunded.
5. PRICES
Our sales prices are ex-works and are quoted in Swiss francs, including VAT, but excluding shipping costs.
6. DELIVERY AND SHIPPING
6.1. SCOPE OF DELIVERY
We generally ship worldwide. We reserve the right not to ship to certain crisis areas.
6.2. SHIPPING COSTS
Shipping within Switzerland and the Principality of Liechtenstein is free of charge. A shipping fee is charged for deliveries outside of Switzerland. For deliveries to neighboring countries (Germany, Austria, France, and Italy), a shipping fee (depending on weight) starting at CHF 38.00 is charged. Shipping to Canada and the USA starts at CHF 48.00. The exact costs will be displayed when you place your order. We generally ship with Planzer and Swiss Post.
7. PAYMENT OPTIONS
For orders within Switzerland and the Principality of Liechtenstein, you can pay using Twint, prepayment, PayPal, or credit card. Orders from abroad can only be paid via PayPal, credit card, or prepayment.
7.1 TWINT
When ordering with Twint, you will be redirected to the Twint app in the shop and prompted to pay via QR code or payment code. You will receive payment confirmation directly through the app. Your package will be shipped immediately upon receipt of payment.
7.2 PREPAYMENT
You can also pay by prepayment. The payment terms will be displayed during the checkout process. You can easily make a payment via bank transfer using the provided information. Your package will be shipped immediately upon receipt of payment.
7.3 PAYPAL
You can also pay for your order via PayPal. Any PayPal fees will be added to your total.
7.4 LATE PAYMENT
In case of late payment, we are entitled to charge you default interest of 10% per annum plus a fee of CHF 10.00 starting with the second reminder. Reminders and invoices will be sent by email. In case of late payment, ‘JG’ is also entitled to assign the claim and associated costs to a third party. We reserve the right to claim further damages.
8. GIFT CERTIFICATES
Gift certificates are vouchers that you can purchase. You can pay for your order with a physical ‘JG’ gift certificate. To do so, please scan the certificate and send it by email to kleid@jgrubenmann.ch. The gift certificate amount will then be deducted from the total order amount when the invoice is sent. If you have a voucher code for the online shop, you can easily redeem it in your shopping cart. The voucher amount is fixed. Vouchers are issued exclusively in CHF and are freely transferable. Cash redemption is not possible.
9. RETENTION OF TITLE
The ordered goods remain the property of JG until full payment has been received.
10. RIGHT OF WITHDRAWAL/RETURN POLICY
You may withdraw from the contract within 14 days of receiving the goods by returning them, stating the reason for the return. Return shipping is at your own risk and expense. Only items that are completely undamaged and in perfect, unworn, and unwashed condition will be accepted for return. In particular, worn, soiled, damaged, or malodorous products cannot be returned. Should this not be the case, we reserve the right to claim compensation. Exchanges of discounted items are not permitted. Returns should be sent to:

The amount of the returned goods will be credited to you as a voucher. This voucher can then be redeemed in the online shop to purchase a new item. Return shipping costs are non-refundable.
11. NOTIFICATION OF DEFECTS
Please inspect the delivered items immediately for accuracy, completeness, and integrity. Complaints regarding the scope of delivery, defects, incorrect deliveries, and quantity discrepancies must be reported to us in writing via email within 5 business days of receiving the goods. The defect will be reviewed by JG immediately. If JG accepts the defect, you will receive a replacement item, if available.
12. CLEANING INSTRUCTIONS / LIMITATION OF LIABILITY
The cleaning procedures recommended by JG for the garments are communicated to the customer in writing or via a sewn-in care label. These recommendations are taken from the fabric manufacturers' data sheets. JG cannot be held liable for the accuracy of the cleaning recommendations, nor for failure to follow them by the customer or the cleaning company. All liability is excluded.
13. DATA PROTECTION
The protection of your personal data is very important to us. JG is authorized to use your personal data to send you special offers or information about new collections. You can revoke your consent to the use of your personal data for advertising purposes at any time by sending an email to kleid@jgrubenmann.ch. For the purpose of a credit check, we obtain credit information when you purchase on account. The data protection declaration is an integral part of these Terms and Conditions.
14. APPLICABLE LAW AND JURISDICTION
The contractual relationship between you and JG is governed by substantive Swiss law. The place of jurisdiction for all disputes is St. Gallen.
